Terms and conditions

These are the arrangements between you and Whole-Fit when you train with us. In plain language, so you know where you stand.

Valid from 9 October 2026. This version replaces the terms of 2 April 2024.
These terms are also on the site in Dutch and German. If there is any difference, the Dutch text applies.

1. Who we are and what we mean

  1. Whole-Fit is the trade name of Whole Fit, Hertzstraat 17, 2041 CT Zandvoort, registered with the Dutch Chamber of Commerce under number 99889501. You can reach us at info@whole-fit.nl or +31 23 23 40 117.
  2. In these terms, we mean by:

    • member: anyone who has a membership with us;
    • participant: anyone who trains with us without a membership, for example through a Drop-In, a trial class or corporate fitness;
    • agreement: the arrangement between you and Whole-Fit about training with us;
    • credit: the right to one training session;
    • Virtuagym: the app and system that hold the schedule, your bookings, your credits and the member records;
    • in writing: on paper, by email or through Virtuagym. A text message counts too, except when you cancel.

2. When these terms apply

  1. These terms apply to all agreements between you and Whole-Fit: memberships, personal training, Drop-In, Open Gym, trial classes, youth fitness and Mama (to be).
  2. For corporate fitness we make separate arrangements with each company in a quote. Where the quote says nothing, these terms apply.
  3. You receive these terms before you sign up, and they are on whole-fit.nl.

3. How the agreement is made

  1. After your intake we make you an offer. That offer is valid for two weeks, unless we name a different period.
  2. Once you say yes to the offer, the agreement is made. Your membership is personal: you cannot pass it on to someone else.
  3. We may change the schedule, the trainers and the content of the sessions. If something essential changes so that you can no longer train as agreed, you may cancel the agreement free of charge.

4. Cooling-off period

  1. If you sign up online or outside the gym, you have a cooling-off period of fourteen days. During that time you can withdraw from the agreement without giving a reason and at no cost. Just send an email to info@whole-fit.nl.
  2. If you sign up at the gym, you have a cooling-off period of one week after signing.
  3. If at your own request you already train during the cooling-off period and then withdraw, you pay proportionally for the sessions you have already had.
  4. There is no cooling-off period for a Drop-In, a single class or any other booking on a fixed date. Cancelling then works as described in article 7.

5. Your membership

  1. A membership runs for 1, 3, 6 or 12 months. You pay monthly by direct debit.
  2. At the end of the term your membership simply stops. It is not renewed automatically. We get in touch before the end, so you can choose whether to continue.
  3. Stopping early is only possible for a serious reason, such as a long illness or injury that stops you from training, or moving to an address more than 25 kilometres from the gym. Let us know in writing. We may ask for proof, such as a statement from your doctor or a record of your new address.
  4. If you stop early, we settle up: if you have used more credits than you have paid for so far, you pay the difference. If you have used fewer, you pay nothing more from the stop date.
  5. If an injury or pregnancy keeps you from training for a while, let us know straight away. Your membership and your payments simply continue. After your recovery or after the birth, we add the time you missed to the end. You pay nothing for that extra time, and your credits stay valid for that much longer. We may ask for a statement from your doctor, physiotherapist or midwife.

6. Credits

  1. Whole-Fit training covers Small Group PT, Boxing, Strength & Conditioning and Hybrid Race Training. One credit is one session.
  2. When your membership starts, you get all the credits for the whole term at once. That way you can make up a missed week later, or train ahead for once.
  3. You book your sessions in Virtuagym. You can cancel up to 12 hours before the session without losing your credit. If you cancel later or do not show up, the credit is used.
  4. Want to switch to another session on the same day? Message us or tell the trainer. Then you keep your credit.
  5. Your credits stay valid until the end of your membership, plus some extra time:

    • 1-month membership: 1 extra week;
    • 3 months: 2 extra weeks;
    • 6 or 12 months: 1 extra month.

    After that, any credits you have not used expire.

  6. Running short of credits? You can buy single credits or a booster pack. Ask your trainer.

7. Drop-In, Open Gym and trial class

  1. With a Drop-In you join one class, without a membership. You book and pay in advance.
  2. You can cancel free of charge up to 12 hours before the class. If you have already paid, you get the full amount back. If you cancel later or do not show up, there is no refund.
  3. If we cancel a class, you always get your money back.
  4. In Open Gym you train on your own. You may only do so once a trainer has shown you the equipment.
  5. A free trial class is a one-off, and commits you to nothing.

8. Personal training

  1. We schedule personal training together.
  2. You can cancel an appointment free of charge up to 12 hours in advance, just like the group sessions. If you cancel later or do not show up, the session counts as given.
  3. If we need to move an appointment, we let you know as early as possible and reschedule it, at no cost to you.

9. Under 18

  1. Youth fitness is for children and teenagers aged 9 to 16.
  2. If you are under 16, a parent or guardian always enters into the agreement. That applies to youth fitness and to Small Group PT. That parent or guardian pays and is our point of contact.
  3. If you are 16 or 17, you need permission from a parent or guardian for a membership.

10. Prices and price increases

  1. We agree on the price before the agreement starts. All prices include VAT.
  2. We may adjust the price for inflation once a year, by no more than the percentage of the consumer price index (CPI) of Statistics Netherlands (CBS) over the previous year. We tell you at least four weeks in advance.
  3. We also tell you about any other price increase at least four weeks in advance. If you do not agree, you may cancel your membership free of charge from the date the new price takes effect.
  4. We never raise the price in the first three months of your membership.

11. Payment

  1. You pay as we agreed, usually by monthly direct debit.
  2. If a payment fails, we send you a reminder. You then have another fourteen days to pay.
  3. If you still do not pay, we may charge the statutory interest and the statutory collection costs. Until you have paid, we may refuse you access to the sessions.

12. Health and house rules

  1. Tell us before you start, and again if anything changes, whether you have symptoms, an injury or a medical condition, take medication or are pregnant. If you are unsure whether you can exercise, ask your doctor first.
  2. Follow the trainers' instructions. Do not use equipment you do not know; ask for an explanation instead.
  3. Do not train under the influence of alcohol, drugs, or medication that affects your reactions. Doping is not allowed.
  4. Bring clean trainers and your own towel. Smoking is not allowed in or around the gym.
  5. Let us know if your address, email address or phone number changes.

13. Liability

  1. Exercise always carries some risk. We do everything we can to train safely, but we are not liable for damage that is not our fault.
  2. If damage arises because we or our trainers do something wrong, we are liable for it. That liability is limited to the amount our liability insurance pays out in that case.
  3. The limit in paragraph 2 does not apply if the damage is caused by intent or gross negligence on our part.
  4. We are not liable for loss, theft or damage to your belongings at the gym, unless it is our fault.
  5. If you cause damage to the gym, the equipment or other people, you are liable for it yourself.

14. If we end the agreement

  1. If you behave seriously inappropriately towards us or other members, or repeatedly fail to follow these terms, we may end the agreement immediately. You then pay what you owe up to that moment. In that case you do not get back what you paid in advance.
  2. If Whole-Fit stops trading, we end the agreement with one month's notice. You get back whatever you paid in advance for the period after that.

15. Privacy and photos

How we handle your data, photos and video is explained in our privacy statement.

16. Complaints

  1. If you are unhappy about something, let us know as soon as possible, ideally within four weeks. The sooner, the better we can sort it out. Email info@whole-fit.nl and describe what is wrong as clearly as you can.
  2. We respond within fourteen days. If we need more time, we let you know within that period when you will get a full answer.
  3. If we cannot resolve it together, you can go to the competent court.

17. If these terms change

  1. We may change these terms. We tell you about any change at least four weeks in advance.
  2. If a change is substantially to your disadvantage, you may cancel your membership free of charge from the date the change takes effect.

18. Applicable law

All agreements with Whole-Fit are governed by Dutch law.
